DECREE OF THE MINISTER OF AGRICULTURE

CONCERNING
THE EXPORTATION FROM THE TERRITORY OF
THE REPUBLIC OF INDONESIA OF ORCHID PLANTS (ORCHIDACEAE)
THE MINISTER OF AGRICULTURE,
Considering:
- a. that by Decree No. Kep.37/5/1968 the Minister of Agriculture has provided for the exportation from the territory of the Republic of Indonesia of orchid plants (Orchidaceae);
- b. that the above-mentioned decree is no longer in keeping with the present-day development;
- c. that based on the above-mentioned facts it is deemed necessary to stipulate again regulations concerning the exportation from the territory of the Republic of Indonesia of orchid plants (Orchidaceae).
In view of:

- 3. Decree of the President of the Republic of Indonesia No. 45/M/1983;
- 4. Decree of the President of the Republic of Indonesia No. 15/1984;
- 5. Regulation of the Minister of Agriculture No. 6/PMP/1961;
- 6. Regulation of the Minister of Agriculture No. 7/1962;
- 7. Decree of Minister of Agriculture and Land No. SK.136/P.A/1963;
- 8. Decree of Minister of Agriculture No. OT.210/706/Kpts/9/1983.
HAS DECIDED
To stipulate:
DECREE OF THE MINISTER OF AGRICULTURE ON THE EXPORTATION FROM THE TERRITORY OF THE REPUBLIC OF INDONESIA OF ORCHID PLANTS (ORCHIDACEAE).
Article 1
As used in this Decree :
- a. "Orchid plant" means any kind of orchid plant propagating material, root, stem, flower, fruit, seed, as the product of orchid cultivation as well as from the wilds;
- b. "Orchid plant propagating material" means orchid plant of pre-flowering size, cultured in a bottle or community pot, or its parts including fruit, seed and pollen which by any means or in any way can be used to multiply or reproduce the orchid;
- c. "Hybrid orchid plant" means orchid plant as the product of crossing or reproduction by orchid cultivators in the form of seed, bottled plant propagating material and community pot;
- d. "Bottled plant propagating material" means propagating material of orchid resulting from seed or tissue culture which is planted in a bottle;
- e. "Community pot" means orchid plant obtained from bottled propagating material with a maximum size of three (3) inches which is planted in a pot.
Article 2
(1) The exportation from the territory of the Republic of Indonesia of hybrid orchid plants and orchid flowers (cut flowers) shall not require a permit.
(2) Wild orchid plants (botanicals) collected directly from the wilds shall not be permitted to be exported from the territory of the Republic of Indonesia except those resulted from multiplication by artificial-pollination or by tissue culture in the form of seed, bottled propagating material and community pot, and for the exportation of which a permit has been issued by the Minister of Agriculture or an official appointed by him.
(3) Wild orchid plants (botanicals) collected directly from the wilds may only be exported from the territory of the Republic of Indonesia for scientific purposes under a permit issued by the Minister of Agriculture or an official appointed by him.
Article 3
(1) The exportation of hybrid orchid plants and wild orchid plants (botanicals) as referred to in Article 2 shall only be allowed if accompanied by a phytosanitary certificate issued by the Centre for Agricultural Quarantine, Ministry of Agriculture.
Article 4
Exemption from the provisions of this Decree shall only be granted by the Minister of Agriculture.
Article 5
By the issuance of this Decree, the Decree of the Minister of Agriculture No. 37/5/1968 dated 27 May 1968 is declared inoperative.
Article 6
This Decree shall come into force on the date of issuance.
